Terms & Conditions – Check&Eat

Check&Eat (“we”, “us”, “our”) is a mobile application and digital service operated by Promising Technology LLC, a company established in New Jersey, United States, operating under the DBA Check&Eat.
These Terms and Conditions govern your access to and use of the Check&Eat mobile application, website, and related services (the “Service”).
By creating an account, downloading, accessing, or using the Service, you enter into a legally binding agreement with Check&Eat.
If you do not agree to these Terms, you must not use the Service.
These Terms apply globally. Mandatory consumer protection and data protection laws in your country of residence remain unaffected.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.
Check&Eat is a digital self-tracking and lifestyle tool that allows users to log and analyze food intake, hydration, activity, and related habits.
The Service may also include features such as meal suggestions, recipe recommendations, and shopping list generation.
The Service is intended for personal, informational, and lifestyle purposes only.
It is not intended to diagnose, prevent, monitor, treat, or cure any medical condition.
You must meet the minimum digital consent age required in your country to use the Service.
Accounts are personal and non-transferable.
You are responsible for:
- maintaining account security
- all activities under your account
We may suspend or terminate accounts that violate these Terms or applicable laws.
You agree not to:
- Use the Service for unlawful or harmful purposes
- Interfere with system security or performance
- Reverse engineer, scrape, or extract data
- Use bots or automated systems without permission
- Misuse nutrition, health, or AI-based features
- Upload infringing, abusive, or illegal content
All content, software, trademarks, and systems within the Service are owned by or licensed to Check&Eat.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
You retain ownership of user-generated content. By submitting content, you grant Check&Eat a worldwide, royalty-free license to use it solely to operate, maintain, and improve the Service.
We may modify, suspend, or discontinue parts of the Service at any time for maintenance, security, legal, or operational reasons.
We do not guarantee uninterrupted availability.
The Service may rely on third-party providers (e.g., hosting, analytics, payments). We are not responsible for the actions or policies of such third parties.
Check&Eat is free to download and use for core meal logging features. Certain features are available only through Check&Eat Premium, an optional paid subscription.
9.1 Subscription plansPremium is offered as an auto-renewable subscription with the following billing periods:
- Monthly – USD 4.99, billed every 1 month
- 3 Months – USD 9.99, billed every 3 months
- Yearly – USD 29.99, billed every 12 months
Premium includes AI photo recognition of meals, voice logging, unlimited barcode scanning, fridge scanning with recipe matching, personalised recipe recommendations and advanced nutrition insights. Core meal logging remains available without a subscription.
9.2 PricingThe prices above are in US dollars and apply to purchases made in the United States. Prices in other countries or regions are set according to Apple’s pricing matrix and are displayed in the app in your local currency before you confirm the purchase. Prices may change; where required by law we will notify you in advance, and any change will apply only to subsequent billing periods.
9.3 Billing and automatic renewalPayment is charged to your Apple ID account upon confirmation of purchase. Your subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
9.4 CancellationYou may cancel at any time through your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access to Premium until that date. Deleting the app does not cancel your subscription.
9.5 Free trials and promotional offersWhere a free trial or promotional price is offered, the applicable terms are shown in the app at the time of purchase. If you do not cancel before the trial ends, the subscription converts to a paid subscription at the standard price. Any unused portion of a free trial is forfeited when a paid subscription is purchased.
9.6 RefundsAll purchases are processed by Apple. Refund requests are handled by Apple in accordance with its policies and can be submitted at reportaproblem.apple.com. We are not able to issue refunds directly.
9.7 Changes to Premium featuresWe may add, modify or discontinue Premium features. If a change materially reduces the value of your subscription, you may cancel as described above.
You may stop using the Service at any time and delete your account.
We may suspend or terminate access if you violate these Terms or applicable laws.
The Service is provided on an “as is” and “as available” basis.
We do not guarantee accuracy, completeness, or fitness for a particular purpose.
To the maximum extent permitted by law, Check&Eat shall not be liable for indirect, incidental, or consequential damages arising from use of the Service, except where such limitation is prohibited by law.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
Mandatory consumer protection laws in your country of residence remain unaffected.
We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
